The 2022 Le Vian Holiday Gift Spectacular Sweepstakes (“Sweepstakes”) is sponsored by Le Vian Corp. (“Sponsor”). The Sweepstakes is governed by these official rules (“Official Rules”), www.levian.com/contestrules.  By participating in the Sweepstakes, each entrant accepts and agrees to abide by these Official Rules, warrants that he/she is eligible to participate and understands that the results of the Sweepstakes, as determined by Sponsor and its agents, are final in all respects. The Sweepstakes is subject to all federal and local laws and regulations and is void where prohibited or restricted by law. 

 

This Sweepstakes is in no way sponsored or administered by Sterling Jewelers Inc. You understand that you are providing your information to Sponsor and not to Sterling Jewelers Inc.

 

ELIGIBILITY – LEGAL RESIDENTS OF THE UNITED STATES:

This Sweepstakes is open only to legal residents of the United States and the District of Columbia and is subject to all applicable US federal, state and local laws and regulations. Void in Puerto Rico, Guam, American Samoa, United States territories, possessions, and protectorates, foreign based United States military installations and wherever restricted or prohibited by law. Entrants must be eighteen (18) years of age or older at the time of entry.

 

Any individuals (including but not limited to employees, officers, directors, consultants, independent contractors, and interns) who have, within the past six months, performed services for Le Vian Corp., Sterling Jewelers Inc. or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes (collectively with Sponsor, and Sterling Jewelers Inc., the “Sweepstakes Entities”), each of their respective affiliates and Immediate Family and household members of such Sweepstakes Entities, are not eligible to enter the Sweepstakes. “Immediate Family” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses of the Sweepstakes Entities, regardless of where they live. Individuals living in the same household as those Sweepstakes Entities, whether or not related, are not eligible to enter or win the Sweepstakes. Sponsor has the sole discretion and right to verify the eligibility of each entrant and to disqualify any entrants that are not eligible per these rules. 

 

SWEEPSTAKES PERIOD

The Sweepstakes starts December 5, 2022 at 12:00AM ET and ends at 11:59 PM ET on December 15, 2022 (“Sweepstakes Period”).

 

HOW TO ENTER

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. During the Sweepstakes Period, eligible entrants may enter the Sweepstakes via either method described below:

 

1. Style Bar Method of Entry: To enter via this method, visit a participating Jared the Galleria of Jewelry® (“Jared”) retail store and, with the assistance of a Jared employee, enter the Sweepstakes via the online Le Vian Style Bar by completing and submitting the online entry form (a “Style Bar Entry”).
2. Mail-In Method of Entry: To enter the Sweepstakes without visiting a Jared® retail store, you may submit a mail-in entry. To enter via this method, write your first and last name, street address, phone number and email address on a piece of paper, insert the paper in an envelope, and mail your entry via first-class mail to: Le Vian Corp. c/o Marketing Department - 2022 Holiday Gift Spectacular Sweepstakes, 235 Great Neck Road, Great Neck, NY 11021 (a “Mail-In Entry” and together with Style Bar Entries, an “Entry” or the “Entries”). Each Mail-In Entry must be mailed separately, postmarked during the applicable Sweepstakes Period, and received within seven (7) days later. All entries made via this method will be deemed made by the natural person whose information appears in the Mail-In Entry.
3. Bonus Methods of Entry: After following the instructions and submitting an Entry, an entrant may obtain additional Sweepstakes entries via either method described below:
   1. Visit https://www.levian.com/StyleBarRegister, create an account, write a product review for any of the products shown on the Le Vian Style Bar and include “#sweepstakesentry” at the beginning of the review, and follow the instructions and complete all required fields including entering your review or feedback in the review text box and clicking “Submit” to receive one (1) bonus entry into the Sweepstakes (a “Review Bonus Entry”). The product review must be posted in accordance with the Style Bar Terms of Use. All Entries must be in English.
   2. Alternatively, to enter the Sweepstakes without providing feedback or a review of a product shown on the Le Vian Style Bar, you may submit a mail-in bonus entry. To receive one (1) bonus entry into the Sweepstakes via this method, write your first and last name, street address, phone number and email address on a piece of paper, insert the paper in an envelope, and mail your entry via first-class mail to: Le Vian Corp. c/o Marketing Department - Additional Entry 2022 Holiday Gift Spectacular Sweepstakes, 235 Great Neck Road, Great Neck, NY 11021 (a “Mail-In Bonus Entry” and together with the Review Bonus Entry, a “Bonus Entry”). All bonus entries made via this method will be deemed made by the natural person whose information appears in the Mail-In Entry.

By entering as outlined above, entrant agrees to these Office Rules. If entrant does not complete the steps above and agree to the Officed Rules, entrant will not be entered into the Sweepstakes or eligible to win the Prize.

Limit: Up to one (1) Entry and one (1) Bonus Entry per person, during the Sweepstakes Period. 

Additional Entry Conditions for the Sweepstakes: 

1. i. Incorrect or incomplete Entries are void and will not be eligible. Sponsor has no obligation to advise an entrant of an incomplete or otherwise non-compliant Entry or Bonus Entry. 
2. ii. Sponsor is not responsible for lost, late, invalid, unintelligible, incomplete, garbled, inappropriate or misdirected Entries or Bonus Entries, which will be disqualified.
3. ii. No mailed, telephoned, faxed, or mechanically reproduced Entries or Bonus Entries, other than those expressly stated and allowed herein, will be accepted.
4. iv. Proof of submission of an Entry or Bonus Entry will not be deemed proof of receipt.
5. v. Receipt of Entries or Bonus Entries will not be acknowledged nor will proof of submission of an Entry form or Bonus Entry be deemed proof of receipt.
6. vi. In the event of a dispute as to any Entry or Bonus Entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant.
7. vii. Any use of robotic, repetitive, automatic, programmed or similar automated Entries or Bonus Entries (including, but not limited to, sweepstakes or contest entry services), regardless of method of submission, are prohibited, and any use of such automated entry methods will cause disqualification.

 

PRIZES AND ODDS

One (1) Prize Winner will receive a two (2) day, two (2) night trip for the Prize Winner and one (1) guest to Las Vegas, consisting of: (i) access to the Le Vian Red Carpet Revue® fashion show and trend forecast, Le Vian charity gala, and Le Vian private party and preview in Las Vegas on June 4, 2023; (ii) roundtrip domestic, coach class airfare for the Prize Winner and one (1) guest to and from the major US airport nearest to the Prize Winner’s residence and Harry Reid International Airport in Las Vegas; (iii) two (2) days and two (2) nights hotel accommodations of Sponsor’s choosing (one (1) standard room, based on double occupancy, room rate and tax only)=. Total approximate retail value (“ARV”): $4,000.00 USD. If Winner chooses not to or is otherwise not able to use airfare, the airfare portion of prize will be forfeited. The odds of winning depend upon the number of eligible Entries received.

 

Travel must be round trip. Sponsor will determine airline, flight itinerary and other trip details in its sole discretion. If in the judgment of Sponsor air travel is not required due to Prize Winner’s proximity to destination, air transportation may be substituted with another method of transportation at Sponsor’s sole and absolute discretion. If Prize Winner elects to partake in any or all portions of his/her prize with no guest, no substitutions will be provided for unawarded portions of prize. Prize Winner will not receive difference between actual and ARV. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All travel must be arranged with Sponsor within five (5) business days of Sponsor notifying Prize Winner. All travel dates will be determined by the Sponsor, and once made may not be altered except by Sponsor. Some restrictions may apply. If Prize Winner is unable to use any portion of the Prize during the time periods specified above, Prize Winner forfeits the Prize in its entirety and an alternate winner may be selected. Meals and beverages, incidentals, tips, or any other personal expenses incurred during the trip are not included. All other expenses not specifically identified as included in the Prize are the sole responsibility of the Prize Winner. Prize Winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Prize Winner and guest must travel the same itinerary or the Prize will be forfeited in its entirety. Prize Winner and guest are solely responsible for obtaining any identification documents necessary for domestic travel. If Prize Winner is not legally eligible for travel to the destination, the Prize will be forfeited in its entirety and an alternate winner may be selected. The guest of Prize Winner must be a legal US resident and at least eighteen (18) years of age or older, unless child or legal ward of the Prize Winner. Prize Winner and guest must comply with all venue and airline rules and regulations.

 

The Prize is not redeemable for cash. Any interpretation of the Prize description or otherwise shall be made within the Sponsors sole discretion. The Prize is not transferable. No prize substitutions, exchanges or cash equivalents will be permitted by the Prize Winner, except that the Sponsor reserves the right to substitute a prize of comparable or greater value in its sole discretion. Acceptance, receipt and use of all or any portion of the awarded Prize is solely the responsibility of the Prize Winner. Prize Winner will be issued a 1099 tax form for the actual value of the Prize.  ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.

 

WINNER SELECTION

A random drawing for the Prize Winner of the Sweepstakes will take place on or about December 28, 2022 via random drawing of all eligible entries and the prospective winner will be contacted via the email address provided at the time of Entry with instructions for confirmation, verification and claiming prize (“Prize Notification”).  Entrants are responsible for monitoring their email accounts for prize notification and other communications related to this Sweepstakes. If the potential winner does not respond and return all documentation, including an Affidavit of Eligibility, Release and Prize Acceptance Form, and an IRS W-9 Form within five (5) business days from the date of the Prize Notification, the potential winner will be disqualified, and an alternate potential winner will be selected from the remaining entries. Upon Sponsor’s receipt of all requested documentation within five (5) business days from the date of the Prize Notification, the potential winner will be confirmed as the “Prize Winner.” If the potential winner fails to comply with these Official Rules, then he/she will be disqualified, and any prize won will be deemed forfeited.  In the event of a random drawing for an alternate potential winner, the Prize will be awarded (assuming a sufficient number of eligible entries are received) to another potential winner following the same procedure as set forth herein.  Prize claims and Entries are sole property of Sponsor and will not be returned.

ADDITIONAL LIMITATIONS

Sweepstakes Entities and their respective parents, affiliates and subsidiary companies, agents and representatives are not responsible for any typographical or other errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any potential prize winner or the Prize Winner, or the distribution of any prize. Any attempt to damage the content or operation of this Sweepstakes is unlawful and subject to legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Sweepstakes, without notice, and for any reason, including, without limitation, if Sponsor determines that the Sweepstakes cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. In the event of any such termination or suspension, a notice will be posted and a random drawing will be held from among all eligible, non-suspect entries received prior to such time.  Sponsor reserves the right, at its sole discretion, to void suspect entries and to disqualify any entrant (and all of his/her entries) from this Sweepstakes or any other promotion conducted now or in the future by Sponsor or any of its affiliates if Sponsor determines that he/she has tampered with the entry process, attempted to circumvent the terms of these Official Rules and/or his/her fraud or misconduct has affected the integrity or fair conduct of this Sweepstakes. Sweepstakes Entities, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of Entry information, or for any technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.  Further, Sponsor and Sterling Jewelers Inc., are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in an entrant’s e-mail account to receive e-mail messages. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the State of New York. As a condition of participating in the Sweepstakes, each entrant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action.

INDEMNIFICATION AND LIMITATION OF LIABILITY

BY ENTERING THIS SWEEPSTAKES EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS THE SWEEPSTAKES ENTITIES, PARTICIPATING ADVERTISING AND PROMOTIONAL AGENCIES AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. THE SWEEPSTAKES ENTITIES AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF ANY PRIZE. THE SPONSOR AND STERLING JEWELERS INC. (INCLUDING ITS AFFILIATES) AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THIS SWEEPSTAKES. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEYS’ FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD-PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. ENTRANT FURTHER WAIVES ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.

 

Entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. You acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

 

Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

 

PUBLICITY

By participating in this Sweepstakes, each entrant grants Sponsor and Sterling Jewelers Inc. (including its affiliates) permission to use his/her name, address, photograph, biographical information, Entry, likeness, prize information and/or comments for promotional purposes in any medium now or hereafter devised, worldwide in perpetuity, without review, notification, permission, or payment of additional consideration, except where prohibited by law, any such use with respect to a minor subject to prior approval of his/her parent or legal guardian. By submitting an Entry, entrants agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Sponsor or Sterling Jewelers Inc. (or its affiliates) on the grounds that any use of the Entry infringes any of the entrant’s rights as creator of the Entry, including, without limitation, copyrights, trademark rights, and moral rights.

 

DATA PRIVACY

Submission of your personal information in connection with this Sweepstakes is and will remain subject to Sponsor’s Privacy Policy available at http://levian.com/privacypolicy/. 

 

SEVERABILITY

If any provision of these Official Rules shall be held invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law and the Sponsor’s fundamental intentions hereunder, and the remaining provisions shall not be affected or impaired, provided, however, that in such cases the parties oblige themselves to use their best efforts to achieve the purpose of the invalid provision by a new legally valid stipulation.

The LE VIAN, Le Vian Red Carpet Revue, jared the galleria of jewelry, and JARED trademarks are trademarks of their respective owners.
